• You are responsible for all activities under your account and during your rental period.
• You shall ensure the console, controllers, and accessories are kept safe and returned in the same condition as delivered.⸻3. Payment Terms• The rental fee is payable in full, in advance, at the time of booking.
• Payments are accepted via UPI, PhonePe, Paytm, or other secure gateways.
• Prices include standard delivery and pickup within Visakhapatnam.⸻4. Shipping Policy
All booked equipment will be delivered to the customer’s address as per the time slot selected on our website at the time of booking. Delivery is free of charge within the Vizag city limits. Customers are responsible for providing accurate delivery details (including address and contact information) to ensure smooth delivery. Any delay caused due to incorrect information provided by the customer will not be the responsibility of PS5 Vizag.⸻5. Return Policy
Once the booking time slot is completed, our team will arrange for pickup of the rented equipment within 24 hours. Customers are required to ensure that the equipment (console, controllers, and accessories) is available in the same condition as delivered. Any intentional delay in returning the equipment or failure to hand it over at the agreed time may result in additional charges as per our rental agreement.⸻6. Restrictions & Intellectual Property• Sub-renting, reselling, or using the equipment for commercial gain without consent is prohibited.
• You shall not tamper with or modify system settings, accounts, or pre-installed games.
• All intellectual property rights in the games and content remain with their respective owners.⸻7. Disclaimer & Limitation of Liability• Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, or suitability of the Services.
• Your use of the Platform and Services is at your sole risk.
• In no event shall we be liable for indirect, incidental, or consequential damages. Our liability shall not exceed the rental fee paid by you or INR 100, whichever is lower.⸻8. IndemnityYou shall indemnify and hold harmless PS5 Vizag, its owners, officers, and employees, against any claim, loss, or demand arising from your misuse of the Services or violation of these Terms.⸻9. Force MajeureWe shall not be liable for any failure or delay in performance of our obligations due to causes beyond our reasonable control including natural disasters, strikes, lockdowns, or technical issues.⸻10. Governing Law & Dispute ResolutionThese Terms shall be governed by the laws of India. All disputes shall be subject to the exclusive jurisdiction of the courts in Visakhapatnam, Andhra Pradesh.⸻11. This cancellation and refund policy explains how you may cancel or seek a refund for a rental booking made through our Platform www.ps5vizag.in (“Platform”).⸻1. Cancellations
• Cancellations will only be considered if the request is made at least 24 hours before the scheduled delivery time.
• Cancellation requests received within 24 hours of the scheduled delivery will not be eligible for a refund, since logistics and scheduling will have already been initiated.
• If the customer is not available at the time of delivery, the booking will be treated as a no-show and no refund will be provided.⸻2. Refund Eligibility
• If the customer fails to submit a valid Aadhaar copy and signed Rental Agreement within 30 minutes of booking, the booking will be automatically cancelled and a full refund will be issued.
• If PS5 Vizag is unable to provide the service due to operational issues, a 100% refund will be initiated.
• No partial refunds will be issued once the console has been delivered, even if the customer chooses to return it earlier than the rental period.⸻3. Damaged or Defective Equipment
• In the unlikely event that equipment is delivered in a damaged or defective condition, the customer must notify our support team immediately at the time of delivery.
• Once the equipment is verified and confirmed to be faulty by us, a replacement unit or full refund will be provided, subject to availability.⸻4. Non-Refundable Services
• Once delivery has been completed, the booking is considered confirmed and non-refundable.
• Damage charges, late return fees, or penalties due to misuse are non-refundable under any circumstances.⸻5. Refund Timelines
• In case of approved refunds, the amount will be processed back to the original payment source.

This Rental Agreement (“Agreement”) is made between PS5 Vizag (“Lessor”) and the undersigned customer (“Lessee”). This Agreement is governed by the provisions of the Indian Contract Act, 1872, and other applicable laws of India. By proceeding with a booking on our website, the Lessee acknowledges that they have read, understood, and agree to abide by the terms and conditions set forth herein. An acknowledgment to this Agreement, along with a valid Aadhaar ID, will be required to complete and validate the booking.⸻1. PartiesLessor: PS5 Vizag
Lessee: CustomerThe Lessee hereby confirms that they are above eighteen (18) years of age at the time of signing this Agreement.⸻2. Equipment DescriptionThe Lessor hereby rents to the Lessee the following equipment (collectively, the “Equipment”):
• One (1) Sony PlayStation 5 Console
• Two (2) DualSense Controllers
• Five (5) Digital Games: Spider-Man 2, God of War Ragnarök, FIFA 25, Red Dead Redemption 2, It Takes Two
• One (1) Power Cable
• One (1) HDMI Cable
• Two (2) Controller Charging Cables
• One (1) Hard Shell Carrying Case
The Equipment is delivered in good working condition and the Lessee acknowledges the same at the time of handover.⸻3. Rental TermThe standard rental period is 20 hours, starting from 2:00 PM on the booking day and ending at 10:00 AM the following day.For extended bookings:
• A 2-day rental runs from 2:00 PM on the first day until 10:00 AM on the third day.
• A 3-day rental runs from 2:00 PM on the first day until 10:00 AM on the fourth day.The Lessee agrees to return the Equipment strictly within the selected rental period. Any delay beyond the agreed end time will result in additional charges at the applicable daily rental rate.⸻4. Fees and Payment TermsThe rental fee is as follows, payable in advance at the time of booking:
• INR 1499 for a 20-hour rental (2:00 PM – 10:00 AM next day)
• INR 2499 for a 2-day rental (2:00 PM Day 1 – 10:00 AM Day 3)
• INR 3499 for a 3-day rental (2:00 PM Day 1 – 10:00 AM Day 4)An Aadhaar copy and an acknowledgement of the Rental Agreement are mandatory for every booking.The Lessee must return the Equipment strictly within the agreed rental period to ensure availability for subsequent bookings. Any delay, even by a short duration, will make the Lessee liable to pay an additional daily rental charge of INR 1499 for each day of delay.Failure to return the Equipment in a timely manner shall constitute a material breach, entitling the Lessor to repossess the Equipment and recover all associated costs.⸻5. Permitted Use and RestrictionsThe Lessee shall:
• Use the Equipment solely for personal, lawful, and non-commercial purposes.
• Not sublet, lend, or otherwise transfer possession of the Equipment to any third party.
• Not tamper with, modify, or remove serial numbers, warranty seals, or security tags.
• Not alter or interfere with the system settings, user accounts, or any pre-installed configurations of the PlayStation 5.
Any unauthorized use shall constitute a breach of this Agreement and may result in immediate termination along with a penalty determined by the Lessor.⸻6. Liability for Damage or Loss
The Lessee accepts full responsibility for any loss, theft, or damage to the Equipment during the rental term, regardless of cause, excluding ordinary wear and tear.
Repair or replacement shall be charged at the prevailing market value. The Lessee further indemnifies and holds harmless the Lessor against any claims, injuries, or damages arising from the use of the Equipment.
This clause is enforceable under the Indian Contract Act, 1872 and the Transfer of Property Act, 1882.⸻7. TerminationThe Lessor reserves the right to terminate this Agreement with immediate effect if:
• The Lessee fails to pay the rental fee,
• The Equipment is misused, tampered with, or damaged,
• The Lessee violates any terms of this Agreement.
Upon termination, the Lessor may repossess the Equipment without further notice.⸻8. Dispute ResolutionAny dispute arising from this Agreement shall be resolved through arbitration under the Arbitration and Conciliation Act, 1996. The place of arbitration shall be Visakhapatnam, India, and the proceedings shall be conducted in English. The courts of Visakhapatnam shall have exclusive jurisdiction over any matters not resolved by arbitration.⸻9.
